Data protection, and therefore the protection of your data, is very important to our practice. This information is intended to explain to you what personal data we collect from you and how we manage it. We also inform you about the applicable data protection law and your resulting rights and who is responsible for them.

What personal data do we use from you?

Personal identification details such as first name, surname, date of birth, address, telephone number, e-mail address, details of your health insurance, such as the name of the insurance company, membership number and your insured status Health data about you such as doctor’s letters, previous admissions, laboratory values, findings, medication plans, implant ID cards if available, severely disabled person’s ID card

What do we need your data for?

Your data is required to fulfill our contractual obligations, for example, to be able to carry out an examination on you. (Art. 6 para. 1 b) EU GDPR) They are also the basis for preparing the corresponding report and being able to bill the cost bearer (the health insurance company) for the service provided. As a medical practice, we are subject to numerous legal requirements (e.g. Social Security Code V, Medical Professional Code, X-Ray Ordinance, Radiation Protection Ordinance, etc.), which authorize us to process your data. (Art. 9 para. 2h) EU GDPR) The personal data that we store about you will only be passed on in individual cases if we are legally obliged to do so (e.g. external requests by supervisory authorities, statutory health insurance, statutory accident insurance) or if the transfer is necessary to fulfill the treatment contract or if you have consented to the transfer (e.g. cooperating doctors or private medical clearing house). The data will only be passed on to the extent necessary or authorized by you. You can of course withdraw your consent at any time. Until then, the legality of the processed data remains unaffected.

Who receives your data?

Our medical practice, the doctor and all employees are subject to the statutory duty of confidentiality in accordance with StGB §203. Access to your data is clearly regulated in the practice. Only those persons who need your data to fulfill their contractual obligations and to implement our legitimate interests have access. To support our work, we work with service providers who help us to comply with legal regulations, e.g. for IT, equipment maintenance or document destruction. The service providers of our medical practice are obliged to maintain confidentiality and only have access to your personal data for clearly defined tasks. As a matter of principle, no personal data is forwarded to a third country.

How long do we store your data?

The statutory retention periods stipulate that the data is stored for as long as is necessary to fulfill legal and contractual obligations (Section 630f (3) BGB, Section 28 (3) RöV); it may be necessary to store your data for a longer period of time if medical or legal concerns such as the preservation of evidence in legal disputes, defense, assertion or exercise of legal claims are involved. The statutory annual limitation periods apply here.

Your right to erasure, information or rectification

In principle, you have the right to have your personal data deleted. It should be noted whether there is a legal reason that requires the processing of your data. Of course, you are entitled to information about your personal data. If the data processed by us is no longer up to date or incomplete, you can request that we correct or complete it.

Your right to object and restriction of processing

If you have objected to the processing of your personal data and it is not yet clear whether your interests prevail, you can request that the processing of your data be restricted.

Your right to data portability

You are entitled to receive your personal data that you have provided to us in a transferable format.

Right of appeal

If you are not satisfied with the way your personal data is processed by the practice or if we have not answered your request regarding the data processed by us to your satisfaction, you have the right to lodge a complaint with the supervisory authority.

To what extent are you obliged to provide the practice with your personal data?

The following personal data is required for the performance of our legally prescribed service:

1. data required for the initiation and execution of the treatment contract 2. data necessary for the fulfillment of the associated contractual obligations 3. data whose collection is required by law Without your personal data, we are unable to enter into or execute a treatment contract with you.
